These Terms of Service govern your use of the Diesel Proof website and your purchase of products from Diesel Proof LLC. By accessing our website, placing an order, or otherwise using our services, you agree to these Terms of Service.

Throughout these Terms, “Diesel Proof,” “we,” “us,” and “our” refer to Diesel Proof LLC. “You” and “your” refer to the customer, website visitor, or other user of our services.

1. Online Store Terms

By using this website, you represent that you are legally capable of entering into a binding agreement and that you will use our website and products only for lawful purposes.

You may not use our products, website, content, or services in violation of applicable federal, state, or local laws or regulations.

We reserve the right to refuse service, cancel orders, restrict access, or terminate use of our services when reasonably necessary to protect Diesel Proof, our customers, our partners, or the integrity of our business.

2. Product Information

Diesel Proof works to provide accurate product descriptions, specifications, images, pricing, and vehicle fitment information. However, product information may originate from manufacturers, distributors, and other suppliers and may change without notice.

We do not guarantee that all descriptions, images, specifications, availability information, or other product content will always be complete or error-free.

Product images may be representative. Actual finishes, colors, packaging, included components, or product appearance may vary due to manufacturer changes.

3. Vehicle Fitment

Customers are responsible for confirming that a product is appropriate for their specific vehicle and intended application before installation.

Vehicle year, make, model, engine, drivetrain, transmission, cab configuration, emissions configuration, and other specifications can affect fitment.

Diesel Proof provides fitment information to assist customers, but customers should verify compatibility before installing or modifying any product.

Do not install a product that appears incorrect for your vehicle or application. Contact Diesel Proof before installation if you have questions regarding fitment.

4. Pricing and Errors

Prices are displayed in U.S. dollars unless otherwise stated.

We reserve the right to correct pricing, product information, promotions, discounts, or other errors at any time.

If an order is placed for a product containing a material pricing or listing error, Diesel Proof may contact you before fulfillment and may cancel and refund the affected order when necessary.

Manufacturer pricing policies, including Minimum Advertised Price (MAP) requirements, may affect advertised prices and promotions.

5. Orders and Acceptance

Submitting an order does not guarantee acceptance or fulfillment.

Orders may be subject to payment verification, fraud review, product availability, manufacturer or distributor confirmation, pricing verification, and other reasonable order-processing requirements.

Diesel Proof reserves the right to cancel or decline an order before fulfillment when necessary, including because of inventory discrepancies, pricing errors, suspected fraud, product discontinuation, supplier availability, or other circumstances preventing fulfillment.

If we cancel an order after payment has been collected, the applicable amount will be refunded to the original payment method.

6. Product Availability and Fulfillment

Many products sold by Diesel Proof are fulfilled directly through manufacturers, distributors, and fulfillment partners.

Inventory information can change quickly and may not always reflect real-time supplier inventory. A product appearing available on our website does not guarantee immediate availability from the applicable fulfillment source.

If a product becomes unavailable after an order is placed, we may contact you regarding an estimated lead time, an alternative product, backorder options, or cancellation and refund.

7. Shipping and Delivery

Shipping eligibility, costs, estimated delivery times, freight requirements, geographic restrictions, and related terms are governed by our Shipping Policy.

Delivery dates are estimates unless expressly stated otherwise. Carrier delays, weather, supplier processing times, freight scheduling, and other circumstances outside Diesel Proof's reasonable control may affect delivery.

Customers are responsible for providing an accurate and deliverable shipping address.

8. Returns and Refunds

Returns, cancellations, damaged shipments, non-returnable products, refund eligibility, and applicable manufacturer or distributor restocking fees are governed by our Return & Refund Policy.

Diesel Proof does not impose a standard restocking fee. Certain manufacturers, distributors, or fulfillment partners may impose their own restocking fees, which may apply to an eligible return.

9. Core Charges

Products requiring a refundable or non-refundable core charge are subject to our separate Core Charge Policy.

Customers are responsible for following the applicable core-return instructions, timelines, and eligibility requirements.

10. Warranties

Products sold by Diesel Proof may include warranties provided by their respective manufacturers.

Unless expressly stated otherwise, manufacturer warranties are administered according to the manufacturer's terms, conditions, exclusions, and procedures.

11. Vehicle Modification and Emissions Compliance

Diesel performance products may affect a vehicle's emissions system, noise level, drivability, warranty coverage, or legal eligibility for operation on public roads.

Certain products may be intended exclusively for competition, racing, off-road, or other restricted applications.

It is the customer's responsibility to determine whether the purchase, installation, and use of a product is legal for the vehicle's intended application and location.

Diesel Proof does not authorize or encourage the unlawful modification, disabling, removal, or tampering of emissions-control equipment.

12. Installation

Unless specifically stated otherwise, products sold by Diesel Proof are supplied as parts and are not sold with installation services.

We recommend that performance, drivetrain, fuel-system, turbocharger, electrical, and other specialized components be installed by a qualified professional when appropriate.

Diesel Proof is not responsible for damage resulting from improper installation, misuse, unauthorized modification, improper tuning, failure to follow manufacturer instructions, or use of a product outside its intended application, to the extent permitted by law.

13. Third-Party Products and Services

Diesel Proof sells products manufactured by third parties and may provide links or access to services operated by third parties.

Manufacturer names, trademarks, product names, and logos belong to their respective owners.

The availability of a third-party product through Diesel Proof does not mean Diesel Proof controls the manufacturer's policies, warranty decisions, product changes, or other independent business practices.

14. Intellectual Property

Unless otherwise indicated, Diesel Proof branding, original photography, graphics, website design elements, written content, logos, and other original materials are owned by or licensed to Diesel Proof LLC and are protected by applicable intellectual-property laws.

You may not reproduce, distribute, commercially exploit, or misrepresent Diesel Proof-owned content without authorization.

Third-party manufacturer trademarks, images, and other materials remain the property of their respective owners.

15. Reviews and User-Submitted Content

If you submit a review, photograph, testimonial, comment, or other content to Diesel Proof, you represent that you have the right to provide that content and that it does not violate the rights of another person or entity.

You grant Diesel Proof permission to use voluntarily submitted product reviews and related content for legitimate business and promotional purposes, subject to applicable law and our Privacy Policy.

16. Prohibited Uses

You may not use the Diesel Proof website to engage in fraud, unlawful activity, malicious interference, unauthorized access, data harvesting, infringement of intellectual-property rights, or conduct intended to disrupt the operation or security of our website or services.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Diesel Proof LLC will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use or inability to use our website, services, or products.
